（略）钱江新城建设管理委员会（主办方）（略）（承办方）（略）（征集代理）作为征集代理，就钱江新城（略）夜景提升设计项目组织开展国际方案征集活动，欢迎有兴趣参与应征的申请人参加本次征集活动。本次征集将通过公开资格预审的方式：（略）
EntrustedbyHangzhouQianjiangNewCityConstructionManagementCommittee(Sponsor)andHangzhouQianjiangHeshengHoldingDevelopmentCo.,Ltd.(Organizer)astheSolicitor(“Solicitor”),ShanghaiInternationalTenderingCo.,Ltd.astheSolicitationAgent(“SolicitationAgent”)（略）,5applicants(“ShortlistedApplicants”)willbeselectedtoenterthefollowingSolicitationStage.
1征集背景ProjectBackground杭州钱江新城是（略）的灯光图景诠释水秀灵动的杭州诗情、解构数字第一城的强势进展，成为（略）“金名片”。2016年后，新城管委会接续发力，全力投入景观照明提升及完善工作，创新性探索实践互动光影秀、灯光秀媒体立面完善等工作，多举措打（略）著名打卡地。杭州亚运会期间，钱江新城景观照明及灯光秀再度实现提档升级，与奥体博览城“一江两岸、双璧辉映”，向全亚洲乃至全世界展现了杭（略）新面貌、新发展。
HangzhouQianjiangNewCityisasignificantstrategyimplementationof"developmentalongtheriver,expansionacrosstheriver"bytheHangzhouMunicipalCommitteeandMunicipalGovernment.Itservesasthe"bridgehead"forHangzhou’stransitionfromthe"WestLakeEra"tothe"QiantangRiverEra".Afteritscompletionandcommissioning,QianjiangNewCityhasgraduallybecomethenewurbancenterandCBD.In2013,anoverallplanwasimplementedforthelandscapelightingandthematiclightshowinQianjiangNewCity,withconstructioncarriedoutinstages.DuringtheG20summitin2016,theCityBalconyNightSceneLightShow(includingtheMediaFacadeLightShow,FountainLightShow,andInteractiveLightandShadowShow)madeastunningdebut.Withtheilluminatedscenesof46buildingsinterpretingthedynamicbeautyofHangzhouandshowcasingtherapidprogressofthecityasaleadingdigitalhub,itbecamethecity's"goldenbusinesscard".Since2016,theNewCityManagementCommitteehascontinuedtoexertefforts,fullyinvestingintheenhancementandimprovementoflandscapelighting,innovativelyexploringtheinteractivelightandshadowshows,improvingmediafacadesforlightshows,andtakingvariousmeasurestocreateafamoustouristdestinationinthecity.DuringtheHangzhouAsianGames,thelandscapelightingandlightshowofQianjiangNewCityunderwentanotherupgrade,shininginharmonywiththeOlympicSportsExpoCity,showcasingthenewappearanceanddevelopmentofHangzhoutoAsiaandtheworld.
现今，以人工智能为引领的元宇宙、AR、VR等新技术在全世界范围内掀起了科技发展新浪潮，重新解构（略）建设、（略）径。以科技赋能文化展陈渐成风尚。后亚运时代，杭州向世界一流的社会主义现代化国际（略）的目标阔步迈进。基于此，钱江新城管委会展开了一系列思考和探索，如何围绕新科技赋能灯光秀这一主题，以全球最佳方案丰富（略）域功能，讲好杭城故事，点（略）形象，进一步擦亮（略）国际化展示窗口。
Nowadays,newtechnologiessuchasthemetaverse,AR,andVR,ledbyartificialintelligence,havesparkedanewwaveoftechnologicaldevelopmentworldwide,（略）,Hangzhoustridesconfidentlytowardsitsgoalofbecomingaworld-classmodern,socialistandinternationalmetropolis.Buildinguponthis,theQianjiangNewCityManagementCommitteehasinitiatedaseriesofreflectionsandexplorationsonhowtoleveragenewtechnologytoempowerlightshows.Thisinvolvesenrichingandexpandingregionalfunctionswiththebestglobalsolutions,tellingthestoryofHangzhou,illuminatingthecity’simage,andfurtherenhancingtheinternationalshowcasewindowofthecorearea.
本次方案国际征集，以“科技、未来、文化、活力”为品牌定位，通过科技赋能灯光秀的技术手段，集聚全球著（略）景观照明和灯光秀的新理念、（略）、新做法。面向全球一流设计团队集思广益、广征方案，力争使钱江新城（略）“夜景观”全面迭代升级。围绕“文化赋能、科技时尚、商务文旅”等，打造高品质灯光秀、高水平活动秀、高水准文化秀，推动钱江新城从CBD（中央（略））到CAZ（中央（略））的品牌升级。
Inthisinternationalsolicitation,thebrandpositioningissetas"technology,future,culture,vitality".Throughtechnologicalempowermentoflightshows,itaimstogathernewconcepts,ideas,andpracticesofrenownedurbanlandscapelightingandlightshowsworldwide.Thissolicitationseekscontributionsfromleadingdesignteamsgloballytoupgradethe"nightscene"ofthecoreareaofQianjiangNewCity.Focusingon"culturalempowerment,technologicaltrends,businesstourism",itaimstocreatehigh-qualitylightshows,top-tiereventshows,andfirst-levelculturalshows,propellingthebrandupgradeofQianjiangNewCityfromCBD(CentralBusinessDistrict)toCAZ(CentralActivityZone).
2征集范围、内容和成果要求Scope,Content,andDeliverablesforSolicitation2.1征集范围：以新城（略）公共空间（T型开放空间，（略）（略）阳台中轴线，钱江三桥至庆春隧道江堤一线）为主轴线，（略）民公园、森林公园、世纪花园，总面积约88万平方米。ScopeofSolicitation:Themainaxisisthepublicspaceinthecoreareaofthenewcity(T-shapedopenspace,fromthecitizencentertothecentralaxisofthecitybalcony,andfromtheQianjiangThirdBridgetotheriverbankoftheQingchunTunnel),supplementedbycitizenparks,forestparks,andcenturygardens,withatotalareaofapproximately880000squaremeters.
2.2征集内容：充分利用现有设备和景观资源，进行灯光概念方案设计、景观概念方案设计及相对应场所的初步业态策划。ContentofSolicitation:Fullyutilizeexistingequipmentandlandscaperesourcestocarryoutlightingconceptschemedesign,landscapeconceptschemedesign,andpreliminarybusinessformatplanningforcorrespondinglocations.
2.3成果要求：包括不限于A3文本及多媒体演示等。其中文本内容暂定为：方案设计说明、相关设计图纸、灯光控制要求、能耗分析及投资估算、分步实施计划（三年期和五年期）；多媒体演示时长暂定不少于5分钟（需配中文解说），其中三维动画时长暂定不少于1分钟。RequirementofDeliverables:TheseincludebutarenotlimitedtoA3documentsandmultimediapresentation.Thetextualcontentistentativelysetasfollows:schemedesignexplanation,relevantdesigndrawings,lightingcontrolrequirements,energyconsumptionanalysisandinvestmentestimation,andphasedimplementationplans(three-yearandfive-yearplans).Themultimediapresentationshalllastnolessthan5minutes(withChinesecommentaryrequired),includinga3Danimationsegmentofnolessthan1minute.
本次方案征集的具体要求和条件以征集人、征集代理与入围应征人签署的《方案征集合同》为准，其中的技术要求以《钱江新城（略）夜景提升设计方案国际征集设计任务书》（《设计任务书》）为准。《方案征集合同》和《设计任务书》仅提供给入围的应征人。
Thespecificrequirementsandconditionsforthisschemesolicitationshallbesubjecttothe"SolicitationContract"signedbytheSolicitor,SolicitationAgentandtheShortlistedApplicantsThetechnicalrequirementsshallbesubjecttothe"DesignProgramBook".TheSolicitationContractandDesignProgramBookareonlyprovidedtotheShortlistedApplicants.
3合格申请人资格条件RequirementsofEligibleApplicants3.1申请人须具有独立承担民事责任的能力，不接受自然人参与应征。AnApplicantmusthavetheabilitytobearcivilliabilityindependently,andtheparticipationofnaturalpersonisnotaccepted.
3.2申请人须在其所在国家（略）合法注册，具有承担本次征集内容相应的设计或设计咨询的业务范围及能力。AnApplicantmustbelegallyregisteredintheircountryorregionandhavethebusinessscopeandabilitytoundertakethedesignordesignconsultingcorrespondingtothecontentofthissolicitation.
3.3申请人须至少具有1个与本次征集项目在规模和内容上相类似的夜景灯光设计项目业绩。AnApplicantmusthaveatleastonenightscenelightingdesignprojectthatissimilarinscaleandcontenttothissolicitationproject.
3.4本项目接受联合体。联合体成员数量不得超过3家。（略）作为牵头单位：（略）

4.3申请人成功领取《资格预审文件》并不意味着其资格条件符合要求。申请人是否符合本公告第3条“合格申请人资格条件”由资格预审评审委员会判定。AnApplicant'ssuccessfulacquisitionofthePrequalificationDocumentdoesnotmeanthatitiseligibleforthisProject.WhetheranApplicantmeetstherequirementsofArticle3inthisAnnouncementisdeterminedbythePrequalificationJury.
5资格预审申请文件的提交SubmissionofApplicationDocument5.1资格预审《申请文件》应以电子文件和纸质文件的形式提交。提交截止时间为2024年5月27日11:00时，提交的时间以电子文件上传成功的时间为准。除了在截止时间前成功上传的《申请文件》外，未在截止时间前上传或以其他形式提交的《申请文件》一律不被受理。TheApplicationDocumentshallbesubmittedinElectronicDocumentsaswellasPaperDocuments.ThesubmissiondeadlineofApplicationDocumentis11:00May27,（略）

5.3申请人应将纸质《申请文件》正本1套，以专人送达或邮寄形式送达征集代理联系人：（略）
5.4申请人应当确保其提交的资格预审《申请文件》的电子文件和纸质文件内容一致。当资格预审《申请文件》的电子文件与纸质文件内容不一致时，以电子文件为准。ApplicantsshallensurethatthecontentsoftheirElectronicandPrintedApplicationDocumentsubmittedareconsistent.IntheeventofanydiscrepancybetweentheElectronicDocumentsandthePaperDocuments,theElectronicDocumentsshallprevail.
6入围方式：（略）
6.2如申请人数量正好为5名，资格预审评审委员会将对申请人的身份和资质、综合实力、主创设计师的资历、设计团队的人员配置等进行是否符合项目要求的判定。如判定符合项目要求，5名申请人直接入围；如判定符合要求的申请人不足5名，征集人保留重新组织资格预审的权利。如申请人少于5名，征集人同样保留重新组织资格预审的权利。Ifthereareexactly5Applicants,thePrequalificationJurywilldeterminewhethertheseApplicantsmeettherequirementsofthisProjectbyreviewingtheiridentityandqualification,comprehensiveability,thequalificationsofthechiefdesigners,andthestaffingofthedesignteams,etc.Ifitisdeterminedthatall5Applicantshavemettherequirements,all5applicantswillbedirectlyshortlisted;iflessthan5Applicantsaredeterminedtohavemettherequirements,theSolicitorreservestherighttoreorganizethePrequalification.Iftherearefewerthan5Applicants,theSolicitoralsoreservestherighttoreorganizethePrequalification.
7方案征集费SchemeSolicitationFee7.1应征方案经方案评审委员会评审符合《设计任务书》要求的，并被征集人确定为第一名方案（中选方案）的应征人将获得方案征集费人民币100万元和方案整合深化费人民币50万元；第二名将获得方案征集费人民币70万元；其余应征人将分别获得方案征集费人民币40万元。TheShortlistedApplicantwhomeettherequirementsoftheDesignProgramBookafterbeingreviewedbytheSchemeReviewCommitteeandisdeterminedasthefirstselectedscheme(winningscheme)（略）
7.2如经方案评审委员会评定，应征人的方案没有达到《设计任务书》要求的，应由方案评审委员会单独出具书面意见且有半数以上评委签字，具体阐明不符合要求的设计内容以及扣款标准，征集人将根据该书面意见扣减直至不支付该应征人的方案征集费。IftheSchemeReviewCommitteeoftheSchemeReviewMeetingmakesthedecisionthatanyApplicant’sdeliverablesofthisProjectfailedtomeettherequirementssetintheDesignProgramBook,theSchemeReviewCommitteeshallprovideawrittenopinionwiththesignatureofmorethanhalfofthecommitteetospecifytheunqualifiedcontentsandthedeductionstandard.TheSolicitorisentitledtodeductaportionorallamountoftheApplicant’sSchemeSolicitationFeeaccordingtothisopinion.
7.3上述7.1条规定的方案征集费和方案整合深化费全部为含税价。ThesolicitationfeeandtheschemeintegrationdeepeningfeefortheschemesstipulatedinArticle7.1aboveareallinclusiveoftax.

10知识产权IntellectualPropertyRights申请人提交资格预审《申请文件》即视为接受以下知识产权条款。
OncesubmittingtheApplicationDocument,Applicantsshallbedeemedtohaveacceptedthefollowingtermsoftheintellectualpropertyrights.
10.1应征人承诺其拥有其提供服务时编制的所有图纸、说明、电子文档和其它相关文件（以下总称“成果文件”）的合法权利和知识产权。TheShortlistedApplicantshallguaranteethatithasthelegalrightsandintellectualpropertyrightsofalldrawings,descriptions,electronicfilesandotherrelevantdocuments(hereinafterreferredtoas"Deliverables")preparedwhenitprovidesservices.
10.2应征人为本项目编制的成果文件系专用于本项目，各方均不得超过此范围使用。TheDeliverablespreparedbytheShortlistedApplicantareexclusivelyforthisProjectandshallnotbeusedbyanypartybeyondthisscope.
10.3所有由应征人编制的成果文件，其署名权归应征人所有。征集人在付清了本公告第7条定义的方案征集费和方案整合深化费后，获得所有成果文件的使用权（包括但不限于对成果文件进行修改，以及复制、发行、展览、放映、（略）络传播、改编、汇编等相关著作财产权）。AllitsDeliverablespreparedbytheShortlistedApplicantshallhavetherightofsignatureownedbytheapplicant.AfterpayingtheschemesolicitationfeeandschemeintegrationdeepeningfeedefinedinArticle7ofthisannouncement,theSolicitorshallobtaintherighttouseallDeliverables(includingbutnotlimitedtomodifyingthedesigndocuments,aswellasrelatedcopyrightrightssuchascopying,distribution,exhibition,screening,informationnetworkdissemination,adaptation,compilation,etc.)
10.4应征人应保证提交的成果文件在中国境内或境外没有且不会侵犯任何其他人的知识产权（包括但不限于著作权、专利权）或专有技术或商业秘密。应征人应保证，如其成果文件使用或包含任何其他人的知识产权或专有技术或商业秘密，应征人已经获得权利人的合法、有效、充分的授权。应征人因侵犯他人知识产权或专有技术或商业秘密所引起的全部法律责任应由应征人承担。TheShortlistedApplicantshallensurethatitsDeliverablesdoesnotandwillnotinfringetheintellectualpropertyrights(includingbutnotlimitedtocopyrightandpatentright)orproprietarytechnologyortradesecretsofanyotherpersonwithinoroutsideChina.TheShortlistedApplicantshallguaranteethatifitsDeliverablesusesorcontainstheintellectualpropertyrights,proprietarytechnologyortradesecretsofanyotherperson,theShortlistedApplicanthasobtainedthelegal,effectiveandsufficientauthorizationoftheowner.TheShortlistedApplicantshallbeliableforalllegalresponsibilitiesarisingfromitsinfringementofothers'intellectualpropertyrights,proprietarytechnologyortradesecrets.
11其他Others11.1资格预审文件使用中文和英文书写。当中、英文两种语言的意思表达不一致时，以中文为准。ThePrequalificationDocumentiswrittenbothinChineseandEnglish.IncaseofinconsistencybetweenChineseandEnglish,Chineseshallprevail.
11.2凡参加本次资格预审的申请人均被视为同意并接受《资格预审文件》的全部内容及条款。AllApplicantsparticipatinginthisprequalificationaredeemedtoagreeandacceptallthecontentsandtermsofthePrequalificationDocument.
11.3申请人在资格预审《申请文件》中所列出的主创设计师须亲自开展本项目的设计工作，须参加项目启动会与现场踏勘，须进行成果方案汇报。因此，请所列出的主创设计师根据征集活动时间安排提前预留时间、做好准备。如因旅行限制原因，例如全（略）域流行病疫情等，主创设计师确实无法赴现场参会的，须在资格预审《申请文件》中进行说明，并承诺将通过视频或电话会议的方式：（略）
11.4本次征集活动及相关文件的最终解释权归征集人。TheSolicitorreservestherightoffinalinterpretationofthisProjectandrelateddocuments.
